What is the Statute of Limitations for Personal Injury in Illinois?
The statute of limitations for personal injury or wrongful death in Illinois
is two years. For most personal injury claims, the limit begins on the
date the injury occurred. For wrongful death, it starts on the date of
death. In cases of medical malpractice, the two-year limit begins on the
date of injury, when you became aware of the injury, or when you reasonably
should have become aware of it.
The statute of limitations for various injury claims is as follows:
-
Property Damage: five years from the date of the incident
-
Product Liability: two years from the date of injury
-
Libel & Slander: one year from the date of the incident
