Adoption Guidance Backed by 20+ Years of Legal Experience

Stepparent, relative, and private adoptions each involve distinct legal requirements under Illinois law. At McCall Law Offices, P.C., we represent Peoria families with personalized guidance tailored to their circumstances. Attorney Christopher McCall has 20+ years of legal experience, including family law, and has handled adoption matters in civil court.

These decisions are deeply personal, but the court process requires careful attention to legal parentage, consent, and filing requirements. We begin by understanding the proposed family arrangement and identifying the legal issues that may affect it.

Adoption Pathways for Peoria County Families

The legal path depends on the relationship between the child, the prospective parent, and the child’s existing legal parents. Our representation includes stepparent, relative, and private adoptions.

Families may consider several adoption pathways:

  • Stepparent adoption: This process establishes a legal parent-child relationship between a stepparent and their spouse’s child.
  • Relative adoption: A grandparent or another family member may seek to become the child’s legal parent.
  • Private adoption: The adoption is arranged without placement by a public child welfare agency.
  • Agency adoption: Placement and approval procedures are connected to an adoption agency.
  • Foster adoption: The process involves the child welfare system and requirements associated with the child’s foster placement.

Agency and foster adoptions may involve requirements that differ from private family arrangements. During a consultation, we can clarify the pathway being considered and whether our representation fits the family’s needs.

The Illinois Adoption Process

Adoptions in Illinois are governed by the Illinois Adoption Act, 750 ILCS 50. The law addresses who may adopt, when consent is required, and how petitioners may obtain a final judgment. Specific requirements depend on the adoption pathway and the legal status of each parent.

A case generally begins with a review of the prospective parent’s relationship to the child and the rights of the child’s existing parents. This review can identify required consents, potential court findings, and any evaluations or approvals that may apply.

Depending on the circumstances, the legal process may include:

  • Identifying the applicable adoption pathway and statutory requirements.
  • Preparing and filing an adoption petition.
  • Addressing required parental consents, surrenders, or court findings.
  • Completing evaluations or approvals required for the particular adoption.
  • Requesting a final judgment at the finalization hearing.

For petitioners in the Peoria area, proceedings may begin in the Circuit Court of Peoria County, part of Illinois’ 10th Judicial Circuit. The Civil Division of the Peoria County Circuit Clerk handles adoption and juvenile cases. The path to finalization depends on the type of adoption, consent issues, and applicable court requirements.

Parental Consent & Parental Rights

Parental consent is often one of the most consequential issues in an adoption. Under Section 8 of the Illinois Adoption Act, consent or surrender is generally required from the child’s mother and, depending on the circumstances, the father unless a statutory exception applies. A father’s consent rights can depend on marriage to the mother or a legal determination of paternity.

A court may consider an exception to consent, including a claim that a parent is legally unfit. Unfitness requires a court finding based on statutory grounds and evidence; it doesn’t result automatically from disagreement with an adoption. Because that determination can affect parental rights, the facts and procedural posture require close review.

Illinois law also controls when a birth parent’s consent becomes valid and irrevocable. A final and irrevocable consent or surrender signed less than 72 hours after the child’s birth isn’t valid. A consent signed on or after the 72-hour point is generally irrevocable except as otherwise provided by the Illinois Adoption Act.

The adopted person’s age can create another consent requirement. If that person is 14 or older when the judgment is entered, the adoption can’t be finalized without their consent. In a stepparent adoption, when the spouses haven’t lived separately for at least 12 months, Illinois law generally requires the adopting parent’s spouse to join the case so the adoption proceeds jointly.
